A lien waiver is a legal document where a contractor, subcontractor, or supplier waives their right to file a mechanics lien against the property for the amount being paid. They protect the property owner from double payment and are typically required before payment is released.
A conditional waiver takes effect only when the stated payment is actually received. An unconditional waiver takes effect immediately upon signing, regardless of whether payment clears. Best practice is to provide conditional waivers with current billing and unconditional waivers for prior payments already received.
